Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and QuantumSparc Technologies Private Limited (“QuantumSparc”, “we”, “us”) governing your use of the Smart Booking mobile applications and related services (the “Service”), including the customer, partner, and driver apps. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Smart Booking is a marketplace that connects users with independent third parties — transport operators, hotels, event vendors, and, where offered, drivers (“Providers”) — to search, book, and pay for intercity bus and micro tickets, hotel stays, event services, and related offerings in Nepal.

We are an intermediary. Except where expressly stated, the travel, accommodation, event, or transport service you book is provided by the Provider, not by QuantumSparc. Your booking creates a contract between you and the relevant Provider. We operate the booking platform; we are not the operator of the underlying service and are not a party to your contract with the Provider. Features or services may be unavailable in certain areas or added or withdrawn, including where required by law or licensing.

2. Eligibility and accounts

• You must be legally capable of entering a binding contract under the laws of Nepal, or use the Service under the supervision and consent of a parent or guardian.
• Provide accurate information and keep your account details current.
• You are responsible for activity under your account and for keeping your credentials secure. Tell us at support@smartbooking.com.np if you suspect unauthorised use.
• Providers additionally confirm they hold the licences and permissions required by law, and are responsible for their listings and the lawfulness of their operations.

3. Bookings, prices, and payments

• Prices, availability, fares, and fees are set by Providers and shown at the time of booking; taxes and service charges apply where indicated.
• When you confirm and pay, your payment is handled by a third-party payment provider. Your booking is confirmed when the Service shows it confirmed and/or issues a ticket, voucher, or reference.
• Any wallet feature holds only refunds and promotional credit. It is not a stored-value or deposit account, cannot be topped up with your own money, and cannot be withdrawn as cash except as expressly stated for eligible refunds.
• You are responsible for reviewing booking details before paying; errors in information you provide are your responsibility.

4. Cancellations and refunds

Cancellation rights, refund eligibility, and any charges depend on the Provider’s policy and the booking type, shown at or before booking. Where eligible, you can request cancellation in the app, and any refund due is processed to your original payment method or wallet in accordance with that policy and applicable law.

5. Your conduct

You agree not to use the Service unlawfully or fraudulently; make fake, speculative, or abusive bookings or impersonate another person; upload unlawful, infringing, or other people’s data without a lawful basis; interfere with or gain unauthorised access to the Service or other accounts; or scrape or misuse data or content. We may suspend or terminate accounts that breach these Terms or the law.

6. Reviews and user content

You keep ownership of the content you submit, but grant us a non-exclusive, royalty-free, worldwide licence to host, store, display, and distribute it within the Service to operate and promote it. You are responsible for your content and confirm you have the rights to share it. We may remove content that breaches these Terms or the law.

7. Provider obligations (Partner and Driver apps)

Providers are solely responsible for the services they offer, the accuracy of their listings and pricing, the fulfilment of bookings, legal compliance (including licensing, taxation, and record-keeping), and the lawful handling of any customer or guest information they collect through the Service, including identity documents captured at check-in. Providers must obtain any consent the law requires from their own customers and guests.

8. Intellectual property

The Service, including its software, design, trademarks, and content (other than user content), is owned by or licensed to QuantumSparc and its client and is protected by law. You may use the Service only as permitted by these Terms. The Service is “Powered by QuantumSparc Technologies Private Limited”, and that attribution may not be removed.

9. Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim warranties regarding the Service and the services offered by Providers, and do not warrant that the Service will be uninterrupted or error-free. We are not responsible for the acts, omissions, quality, safety, legality, or performance of Providers or their services.

10. Limitation of liability

To the maximum extent permitted by law, QuantumSparc and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service or your dealings with Providers. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold harmless QuantumSparc from claims, losses, and expenses arising from your breach of these Terms, your misuse of the Service, your content, or your violation of any law or third-party right.

12. Suspension and termination

You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service and its users. Provisions that by their nature should survive termination will survive.

13. Governing law and disputes

These Terms are governed by the laws of Nepal. The courts of Nepal have jurisdiction over any dispute arising from these Terms or the Service, without prejudice to any mandatory consumer-protection rights you have under applicable law.

14. Changes to these Terms

We may update these Terms as the Service or the law changes. We will revise the “Last updated” date and, for significant changes, give more prominent notice in the app. Continued use after an update means you accept the revised Terms.
